THE ARBITRATOR SHALL NOT HAVE ANY AUTHORITY TO AWARD PUNITIVE DAMAGES, ANY AMOUNTS FOR ALLEGED PAIN AND SUFFERING, OR ANY AMOUNT TO YOU IN EXCESS OF THE TOTAL FEES THAT YOU HAVE PAID TO STAMER CHADWICK SOEFJE, PLLC IN CONNECTION WITH SUCH MATTER. THE ARBITRATION PROVISION DOES NOT PREVENT A PARTY FROM APPLYING TO A COURT OF COMPETENT JURISDICTION FOR INJUNCTIVE AND OTHER FORMS OF INTERIM OR EQUITABLE RELIEF. THE PARTIES AGREE THAT THE ARBITRATION AWARD WILL NOT BE APPEALED. THE PARTIES AGREE THAT THE ARBITRATOR SHALL DECIDE WHICH PARTY OR PARTIES SHALL PAY FOR THE COSTS AND EXPENSES OF ALL ARBITRATION PROCEEDINGS. YOU UNDERSTAND THAT IN THE ABSENCE OF THIS PROVISION, YOU WOULD HAVE HAD A RIGHT TO LITIGATE DISPUTES THROUGH A COURT, INCLUDING THE RIGHT TO LITIGATE CLAIMS ON A CLASS-WIDE OR CLASS-ACTION BASIS, AND THAT YOU HAVE EXPRESSLY AND KNOWINGLY WAIVED THOSE RIGHTS AND AGREED TO RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION IN ACCORDANCE WITH THIS SECTION.
