A highly popular lecturer and the author of hundreds of employee benefit related publications and programs, Ms. Stamer is nationally and internationally recognized for her more than 17 years experience advising health and other employee benefit plans, their sponsors, fiduciaries, and services providers, and others about a diverse range of employee benefit and related matters. Whether acting as a legal counselor and consultant, Chair of the Welfare Plan Committee of the ABA Real Property & Trust Section, Vice Chair of the ABA Health Law Section Managed Care and Insurance Interest Group, or her numerous other employee benefit related leadership roles, Ms. Stamer is known for her ability to help clients develop practical solutions that take into account the fundamental people focus of a particular employee benefit arrangement while responding to the legal and other complexities associated with the arrangement.

Examples of employee benefit matters on which she regularly advises clients include:

  • Advise for-profit, non-profit and governmental benefit plans, their plan sponsors and their fiduciaries about welfare benefit, qualified and non-qualified deferred compensation, severance, and other employee benefit, fringe benefit and compensation programs including 401(a), 403(b), 457, health benefit, cafeteria, Social Security opt-out and other benefit and fringe benefit programs including design, documentation, tax qualification, RFP and vendor selection, administration, communications, tax reporting and withholding, state law requirements, fiduciary responsibility, investment policy, disputes, audits, and other related concerns including 403(b) any-willing provider rules, HB 3343 subsidy, government contracting requirements, 457 plan permissibility, and other matters
  • Design, review, documentation, interpretation, negotiation and administration of health, severance, pension, and other employee benefit plans, summary plan descriptions, administration forms and practices, notices, employee communications, claims procedures, COBRA, HIPAA privacy and security procedures and practices, alternative dispute resolution and grievance procedures, vendor agreements, and other related documents and procedures
  • Prepare and submit tax qualification, exemption, private letter ruling and other determination requests, defend against investigations and audits, and represent employee benefit plans, administrators, exempt organizations, government entities, and businesses before IRS, DOL, Health and Human Services, Department of Justice, Departments of Insurance and others
  • Advise plan sponsors, fiduciaries, custodians, trustees, bankruptcy trustees, boards of directors, debtors and vendors about prevention, risk management, and resolution of fiduciary liability concerns, including company stock and other investments, vendor selection and oversight, fiduciary decision-making and oversight, plan amendment and termination, and related matters for 401(k), and other pension and profit sharing arrangements.
